Italian property law does not provide for a neutral third-party holding structure (escrow) or a private insurance product covering title defects. Legal status is verified through the Catasto (land registry) and municipal planning offices. Verification must be conducted by an independent legal advisor — not the notary, who acts as a neutral public official. MG Law Firm handles this verification for all Living Italy transactions.

The Italian Notaio authenticates the rogito notarile (final deed) and verifies formal legal compliance. However, the notary does not advise the buyer on commercial risk, undisclosed liabilities, or whether the agreed price reflects market value. Independent legal counsel — which Living Italy provides through MG Law Firm — is required to protect the buyer’s position.

Living Italy operates under a mandato di acquisto — a formal buyer representation mandate that creates an exclusive obligation to the buyer. This is structurally different from the standard mediatore model, where the agent legally collects commission from both parties (doppia provvigione) and owes no fiduciary duty to either.

 

The three phases are not mandatory service bundles. Clients who want only acquisition advisory receive only that.
